We take the utmost care to ensure our varieties are true to name. To the best of our knowledge, we guarantee that our varieties are accurately named. This warranty is exclusive, and we disclaim all other warranties, whether written or oral, express or implied, including, without limitation, any warranty of merchant ability or fitness for a particular purpose.
The remedies provided herein are the sole and exclusive remedies available. Our responsibility is limited to, at our option, replacing any nursery stock proven to be untrue to name, or refunding the original purchase price. We shall not be liable for any direct, indirect, special, incidental, or consequential damages (including loss of profits), whether based on contract, tort, or any other legal theory.
Our liability shall not exceed the original purchase price. If any limitation of warranty or disclaimer of liability is found to be unlawful or inapplicable, our liabilities shall be limited to the amount paid for the specific nursery stock that caused such liability. While we strive to maintain an accurate inventory, we cannot guarantee that all items will be available when your order is received.
Claims & Returns
- Claims Window and Process
- At T&L Nursery we take pride in growing and shipping you the
best quality plants, but extenuating circumstances sometimes arise.
- All claims must be made within 48 hours of receipt of delivery.
- At the time of delivery, it is the responsibility of the recipient to check in all products and notate any discrepancies on the invoice with our driver.
- Invoices will be updated, and a new copy will be emailed.
- If damage or shortages are noticed after the driver leaves, notify our office immediately. Invoice changes and/or credits will only be honored within the 48-hour period.
- At T&L Nursery we take pride in growing and shipping you the
best quality plants, but extenuating circumstances sometimes arise.
- Eligible Return Conditions
- Returns will be considered on a case-by-case basis.
- To be considered for a return:
- Items must be in a healthy condition and show clearly that they have been maintained properly since leaving T&L.
- Proper maintenance includes but is not limited to maintained water needs, performing required pruning, trimming, deadheading, exercising necessary IPM, and any other actions needed to maintain plant health.
- All original tags, packaging, and accessories must be included.

Donations
Freight & Delivery Charges
This policy outlines the freight and delivery charges applied to all delivery orders. This policy covers domestic shipping only, delivery options, and any associated fees.
- Delivery Charges Overview
- Standard Delivery: Delivery charges are calculated based on location of recipient/site. These charges will be displayed within the order acknowledgement.
- T&L does not profit from deliveries, and aims only to cover costs of shipping.
- Deliveries that fill an entire truck or more are subject to a "full truck fee" to be established at time of contract execution and/or order submission.
- Expedited Shipping: Additional fees apply for expedited options (e.g., overnight or 2-day shipping) and will vary depending on destination and order size. Any request for expedited shipping will be reviewed by management to determine feasibility.
- Freight Shipping: Orders requiring special freight shipping (e.g., oversized items) will incur additional charges based on weight and destination.
- Standard Delivery: Delivery charges are calculated based on location of recipient/site. These charges will be displayed within the order acknowledgement.
- Freight and Minimum Requirements
- All deliveries will be charged freight and all deliveries must meet our minimum per region.
- Orders below the set minimum for each region will be delayed to the next available ship date until the order minimum is reached.
- Add on orders are generally not charged additional freight. Should additional fees need to be added, customer service will reach out to the customer.

- Delivery Zones and Schedule
- T&L has set shipping days for each region we ship to. For more detailed information, please inquire with your Sales Representative or email us at info@tandlnursery.com.
- Recipient’s region will determine order deadlines for same week shipping.
- Order Tracking and Notifications
- Customers will receive confirmation of planned shipment via email once the order is pulled and organized for the following day’s routes.

Pre-Books, Pre-Orders, & Custom Grows
At T&L Nursery, we understand the importance of planning ahead for your plant material needs. Our Pre-Books, Pre-Orders, and Custom Grows allow you to secure specific items before they are officially listed on our availability list. This policy outlines the details for placing these orders, including ordering timelines, minimum quantities, and other important terms.
- Pre-Book Orders
- Items in the Pre-Booking Program are grown specifically for each order. Once production begins, orders cannot be canceled or modified. These items are produced in addition to our regularly forecasted inventory.
- Minimum Order Quantities
- Pre-Book orders require minimum quantities that vary by program.
- Orders that do not meet the minimum required quantities for the program will not be accepted.
- Ready Dates
- Due to the made-to-order nature of Pre-Book items, specific ready dates are not provided at the time of order submission.
- Pre-Book items will be presented alongside projected ready dates for similar products in our regularly scheduled inventory.
- To finalize a ready date for your Pre-Book items, customers will need to work directly with their Sales Representative.
- Order Deadlines & Availability
- Orders placed after the program submission deadline may not be accepted or could be subject to availability constraints.
- All Pre-Book orders will be fulfilled on a first-come, first-served basis.
- Product Availability
- All orders are subject to availability. We will do our best to fulfill your order, but quantities may be limited based on production and demand.

At T&L Nursery, we strive to provide accurate and up-to-date information regarding product pricing and availability. However, due to the dynamic nature of live plant material and industry conditions, we ask that customers review the following policy when placing orders:

- Live Inventory Limitations
- As a wholesale nursery, our inventory can change rapidly. Plant material may sell out between the time an order is placed and the time it is confirmed or pulled.

Quotes & Bids
At T&L Nursery, we’re always happy to receive inquiries and provide pricing information to support your planning and purchasing needs. While we don’t typically spend a lot of time preparing formal bids, we welcome the opportunity to help when we can.

Restocking Fee
This policy outlines the conditions under which a restocking fee applies for returned items, the percentage of the fee, and any exclusions.

- A restocking fee of 15% of the item's purchase price may be applied to returns.

The following terms and conditions govern all sales made by T&L Nursery. By placing an order, the customer agrees to be bound by these terms. We reserve the right to update or modify these terms at any time without prior notice.
- Payment Terms
- Cash on Delivery (COD)
- All COD orders must be paid in full at the time of delivery. Accepted forms of payment include business checks, certified checks, or credit card (Visa or Mastercard only). Failure to provide payment upon delivery may result in refusal of service and additional charges.

- Credit Terms
- Customers interested in establishing credit with T&L Nursery must complete and submit a credit application. Please allow up to four (4) weeks for processing and approval. Credit approval is subject to a satisfactory review of trade references, payment history, and other relevant financial information.
- Once approved, credit terms will be assigned based on the customer’s financial profile and purchase volume. Our standard credit term is Net 30, meaning:
- Net 30 – Payment is due 30 days from the date of invoice.
- Other terms may be assigned as appropriate:
- Net 15 – Payment due 15 days from the date of invoice
- Net 45 – Payment due 45 days from the date of invoice
- Net 60 – Payment due 60 days from the date of invoice
- Net 70 – Payment due 70 days from the date of invoice
- Net 90 – Payment due 90 days from the date of invoice
- Credit terms are subject to change based on account activity, payment history, and volume of business. T&L Nursery reserves the right to modify or revoke terms at any time.
- Late Payment and Finance Charges
- Invoices not paid within the assigned term will be considered past due and subject to the applicable finance charge of 1.5% per month (18% annual rate) on the outstanding balance. Continued late payment may result in a change to COD status or suspension of future orders.
- Returned Checks
- A $35.00 fee will be assessed for any returned or dishonored checks. Future orders may be restricted to certified funds only.

Will Call
T&L Nursery is pleased to offer a Will Call service for customers who prefer to pick up their orders directly from our facility. This service is provided free of charge as a convenience to our valued customers.
- Placing a Will Call Order

- Place your order through our website using your customer login. Orders placed online by the end of the business day will typically be pulled and ready for pickup by 11:00 AM the following business day.

- Please note that availability is confirmed at the time the order is pulled. Item availability may be adjusted based on quality and quantity at the time of selection by our crew.

- We kindly ask that all Will Call orders be picked up promptly. If an order remains uncollected for an extended period, it may be returned to stock to ensure the health and quality of plant material.
- Restocking Fee

- Additional Notes
- Will Call is a complimentary service — there is no charge for having your order pulled and staged for pickup.
